Terms of Service

The terms we operate under

This document covers the related agreements between On The Fly and the people and organisations who use the platform: clubs, members of those clubs, and individual users with an account. Each clause is labelled so you can tell which group it applies to.

1. Who these terms are between

"On The Fly" is operated by Edrean Ernst, sole proprietor, of PO Box 91, Tzaneen, 0850, South Africa. Throughout this document, "we" and "us" refer to On The Fly.

"A club" is a flyfishing club or similar member-run organisation that has registered to use the On The Fly platform to manage its members, resources (waters, beats, accommodation, equipment, and anything else the club makes bookable), pricing rules, and club membership fees.

"A user" is an individual who has registered an account on On The Fly. Anyone with an account is a user, whether or not they belong to a club at any given moment.

"A member" is a user who has been registered with a specific club on the platform. Every member is therefore also a user. Members use the platform to find, book, and pay for resources offered by their club, and to pay club membership fees.

Clauses are labelled Clubs:, Members:, or Users: where they apply to one group specifically. Unlabelled clauses apply to everyone using the platform.

2. What the service is

On The Fly provides a software platform that lets clubs manage memberships, members, waters and beats, permits, accommodation, other bookable resources, and pricing rules. It lets members of those clubs find available resources and book them from a phone or computer, and it facilitates payment from members to clubs for bookings and for club membership fees.

On The Fly is the technology platform. The underlying service being paid for (water access, fishing permits, accommodation, equipment, guidance, club membership, anything else the club offers) is provided by the club, not by us. We do not own the water, set the rules of the water, or control whether the booking actually happens on the day.

3. Acceptable use

You agree to use On The Fly only for its intended purpose. In particular:

  • Users: keep your account credentials secure; do not attempt to interfere with, scrape, reverse-engineer, or overload the service; do not use the platform to send unsolicited communications to anyone; do not use it to break the law.
  • Members: only book on behalf of yourself and the people you have explicit consent for; do not submit fraudulent bookings or membership-fee transactions; do not misrepresent your club affiliation; do not attempt to make payments you are not entitled to authorise.
  • Clubs: only register members with their consent; do not use the platform to collect personal information for purposes the member has not consented to; honour the bookings and memberships you accept.

We may suspend or terminate access if these rules are seriously or repeatedly broken. Where practical, we will notify you first and give you a chance to address the issue.

4. Payment and the role of Paystack

Members: when you confirm a payment to a club (a booking, a membership fee, or any other transaction the club has configured), you authorise payment from your nominated payment method through our payment processor, Paystack. The price shown to you at the moment of confirmation is the price charged. See our Pricing page for how our platform commission works.

Clubs: when a member completes a payment through On The Fly, the net amount (the amount the member paid, less our 5% platform commission and less Paystack's processing fee) is paid to the club via Paystack's split-payment mechanism. The club is the merchant of record for the underlying service or membership.

Paystack is not a party to disputes between On The Fly, the club, or the member. Paystack's role is limited to processing the payment. Complaints about the booking itself, the water, the membership, or the service are between the parties to the transaction and, where relevant, On The Fly as the platform operator. Paystack's own terms of service apply to the payment-processing layer.

5. Refunds

Refund terms are set out in full on our Refunds page. In short:

  • Clubs: there is no platform subscription, so there is no platform-subscription refund. We do not charge clubs to use the platform.
  • Members: refund rules on bookings and membership-fee transactions are set by the club you transacted with, displayed to you at the moment of payment, and executed technically by On The Fly when the club authorises the refund. On The Fly's 5% commission and Paystack's processing fee are non-refundable on refunded transactions, because they cover services already rendered.

6. Intellectual property

On The Fly retains all intellectual property rights in the platform itself: the software, design, brand, and documentation.

Clubs: you retain ownership of your club's data, including the member list, waters and beats, accommodation and other resources, pricing rules, bookings, membership records, and audit log. You license us to host, process, and display that data only as necessary to operate the service for you. You can export it at any time, and if you leave we delete it on request (see promise 3 of the Data Charter).

Members: you retain ownership of the content you submit (catch reports, water-condition feedback, profile information). You license us to display it to your club's committee and other club members as appropriate, and to use it in aggregated, anonymised form to improve the platform.

7. Limitation of liability

On The Fly is provided as is. We work hard to keep the platform working correctly, but we do not guarantee that it will be uninterrupted, error-free, or always available.

To the maximum extent permitted by South African law, On The Fly is not liable for:

  • Indirect, incidental, consequential, or special damages (including lost time on the water, lost catches, travel costs to and from a cancelled booking, or lost business opportunity).
  • Any act, omission, or service failure of the club whose water you booked. The club is responsible for the underlying booking.
  • Service interruptions caused by our service providers (including Paystack and Amazon Web Services) where the interruption is outside our reasonable control.

Where we are liable, our total liability for any one matter (or connected matters) is limited to the total fees paid by you to On The Fly in the 12 months immediately preceding the matter giving rise to the liability. For clubs, that figure is zero, because clubs pay nothing. For members, it is the total of our 5% platform commission on bookings you have made in that period.

Nothing in this clause excludes liability that cannot be excluded under South African law. That includes, for example, liability for fraud, gross negligence, or breach of statutory consumer protection that cannot be contracted out of.

8. Governing law and disputes

This agreement is governed by the laws of the Republic of South Africa.

If you have a problem with the service, please email info@onthefly.club first. We will try to resolve it in good faith by direct correspondence.

If that does not resolve the issue, the dispute may be referred to the South African courts of competent jurisdiction. For members who qualify, the Consumer Protection Act's complaint mechanisms and the National Consumer Tribunal remain available; nothing in this clause prevents you from using them.

9. Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will email registered users a short notice before the change takes effect. If a material change is unacceptable to you, you may stop using the service and (for clubs) export and delete your data per the Data Charter.

10. General

If any part of these terms is found to be unenforceable, the rest remains in force. Our failure to enforce a clause on one occasion does not waive our right to enforce it later. These terms, together with the Privacy Policy and Refunds Policy, constitute the agreement between us.
